1.4 If you are under the age of thirteen, please ask your parents or legal guardian to register or exit this Site.

1.5 This Privacy Policy applies only to information collected by RPG via our Site and does not extend to any other website, whether or not it is affiliated or linked to our Site or to RPG.

2. CHANGES TO OUR PRIVACY POLICY

2.1 We may make any change to this Privacy Policy at any time. If we make any material changes, we will notify you by sending you an email to the last email address that you provided to us and/or by posting a copy of the changes on our Site. Subject to paragraph 2.2, any changes will take effect seven (7) days after the date of our email or the date we post the modified terms on our Site, whichever is earlier. Your continued use of our Site after that period expires means that you agree to be bound by the modified terms. As noted in our Terms & Conditions, you are responsible for keeping your account information up to date, including your parent or legal guardian’s email address. If the email address to which we send notification to you under this clause is no longer valid, the sending of our email (notifying you of any changes to the Terms & Conditions) will be deemed, nonetheless, to be effective notice of the modified terms.

2.2 If we make any material changes in the way we collect, use and/or share personal information, we will give you prominent notice of these changes and offer you a choice about whether the changes should apply to any personal information that we previously collected from you. If we make material changes to how we collect and use personal information from children under the age of 13, we will notify parents or legal guardians by email in order to obtain verifiable parental or legal guardian consent for the new uses of your child’s personal information.

3. PERSONAL INFORMATION

3.1 Personal information is information through which you can be identified.  RPG only collects personal information that you voluntarily provide to us when you register with our Site or contact RPG via our Site in order to receive newsletters, new product launch information, special events, answer surveys, enter contests and receive notice of other promotional opportunities.  RPG may also use the information that you provide to create a personal customer profile in order to let you know of products or events that may be of special interest to you.

3.2 Subject to paragraph 3.3, RPG will neither disclose, sell or rent any information about you to a party unaffiliated to RPG unless ordered to do so under subpoena or if RPG reasonably believes that you have used information from OUR Site in order to commit unlawful acts or acts that may endanger the health and/or safety of the public.

3.3 RPG may appoint third party service providers to administer and/or operate certain functions or services relating to our Site, the proper performance of which may require a transfer of the information submitted to you.  And such transfer shall be under strict confidentiality and security obligations and for the sole purpose of the performance of those obligations.

4. THE INFORMATION WE COLLECT AND HOW WE USE IT

4.1 The following information is required to enable you to create a KidsStagramCLUB Account at https://www.EthanFoxBooks.com and/or https://www.KidsStagram.com. The information we collect on our Site and the way we use that information includes the following:

For users of all ages, we collect:

4.1.1 Your date of birth – this is not displayed publicly on our Site. We only use this information to:

4.1.1.1 verify your age for the purposes of determining whether we need to seek your parent or legal guardian’s verifiable parental consent for your use of our Site; and

4.1.1.2 verify your age to ensure that you only receive communications that are appropriate for your age.

4.1.2 Your country of residence – we only use this information to:

4.1.2.1 present the correct version of our Site and the correct version of any information relevant to your use of our Site to you; and

4.1.2.2 create your identity on our Site in conjunction with other information you provide.

For users under 13 years of age, we also collect the following for internal purposes only:

4.1.3 Your first and surname – this is not displayed publicly on our Site. We only use this information to:

4.1.3.1 allow your parent or legal guardian to identify you as the subject of a request by us for their permission for you to access and use our Site.

4.1.4 Your parent or legal guardian’s email address – this is not displayed publicly on our Site. We only use this information to:

4.1.4.1 provide your parent or legal guardian with details regarding our use of the information that you provide to us;

4.1.4.2 request permission from your parent or legal guardian for you to access and use our Site;

4.1.4.3 request that your parent or legal guardian accepts the Terms & Conditions on your behalf;

4.1.4.4 manage and communicate with you and your parent or legal guardian about your access to, or use of, our Site, as well as to inform you and them of updates to your account on our Site;

4.1.4.5 send your parent or legal guardian a password reminder upon your request; and

4.1.4.6 reply to any correspondence sent to us.

For users aged 13 and over, we also collect:

4.1.5 Your first name and surname – this is not displayed publicly on our Site. We only use this information to:

4.1.5.1 identify and address you when communicating with you about your access to, or use of, our Site; and

4.1.5.2 ensure that we correctly associate your account with another of your online accounts when you choose to link those accounts together (for example, when linking a social networking site account).

4.1.6 Your email address – this is not displayed publicly on our Site. We only use this information to:

4.1.6.1 manage and communicate with you about your access to, or use, of our Site, as well as to inform you of updates to your account on our Site;

4.1.6.2 reply to any correspondence sent to us;

4.1.6.3 for any other reasonable purposes related to our Site or your KidsStagramCLUB Account.

For users aged 16 and over, we also collect:

4.1.7 Your marketing preferences – these are not displayed publicly on our Site. In addition to the purposes stated above, we will use your email address to:

4.1.7.1 send you marketing communications from time to time containing (i) general news about our Site and the world of Ethan Fox Books; (ii) news regarding activity and content on our Site; (iii) special offers and promotions on products and/or services that are closely connected with our Site and the Ethan Fox Books franchise; but only if you indicate that you wish to receive such marketing communications at the time you create your KidsStagramCLUB Account. After receiving your permission to do so, we will send you marketing communications until you indicate that you wish to stop receiving such communications, which you can do at any time by editing your settings and unsubscribing from our Site emails.

4.2 Our Terms & Conditions prohibit the posting or uploading of your or any other person’s personal information on our Site regardless of your age. All postings and uploads are subject to review by us before being disclosed to other registrants on our Site. In the event that you submit postings or uploads containing personal information in breach of this Privacy Policy and our Terms & Conditions, we will collect that information as part of the reviewing process. However, we will remove any personal information or unacceptable material during our review of your submission before allowing your post or upload to appear on our Site. We may refuse to upload your post in its entirety if it contains personal information. Any personal information we collect as a result of your breach of the Terms & Conditions will be deleted as part of our reviewing process.

4.3 We may suspend or terminate your access to our Site in accordance with the Terms & Conditions if you post or upload material containing personal information relating to you or any other person. For further details regarding users’ misuse of our Site, please see our Terms & Conditions.

5. HOW ELSE MAY WE USE YOUR PERSONAL INFORMATION?

5.1 We may use your personal information to investigate a complaint made by another user, a breach of our Site’s Terms & Conditions and to prevent and detect criminal activity, fraud and misuse of, or damage to, our Site or the service available through it and to take appropriate legal action against those responsible.

6. INFORMATION SHARING AND DISCLOSURE

6.1 We do not sell or rent your personal information.

6.2 We share your personal information with authorized third parties for the purpose of operating, managing and administering the accounts and services provided to you through our Site. Such third parties including hosting, ecommerce fulfilment, moderation and payment and support service providers. We may further share and disclose this information with other third parties including our commercial partners from time to time (hereinafter, referred to as “Partners”) in order to better integrate their services with our Site. Before we share or disclose any of your personal information with our Partners (for example, by linking your account on our Site with your account on a Partner’s service) we will always first ask you for your permission to do so.

6.3 If you are under the age of 16, we use any personal information we collect from you for internal purposes only.

6.4 We do not send any personal information that we collect about you on our Site to any social networking sites that you link to your KidsStagramCLUB Account nor do we share that information with such sites. We do not collect any personal information about you from those sites. We may, however, disclose personal information about you to the following, for the express purposes set out below:

6.4.1 If you create a KidsStagramCLUB Account with our https://www.EthanFoxBooks.com Site: 

6.4.1.1 to our employees, agents and authorized third party providers for them to administer any accounts or services provided to you through our Site for example the sending of e-alerts on our behalf.

6.4.1.2 If you check the relevant box to permit communications from our Partners, to those partners, their employees and agents for them to send you communications regarding goods and services they offer.

6.4.2 Transfer of business:

6.4.2.1 if there is a change (or prospective change) in the ownership of our Site or any of its assets, we may have to disclose personal information to the new (or prospective) owner. If we do so, we will require them to keep it confidential and use it in accordance with the terms of our Privacy Policy.

6.4.3 Legal requests:

6.4.3.1 Apart from the use and sharing of your personal information in the limited circumstances already described, the only ways we may share your information are if we need to disclose personal information to protect our and our licensors’ rights and property or to comply with any applicable law or valid legal process.

7. OTHER TYPES OF INFORMATION WE COLLECT AND USE

7.1 We aim to provide a number of features on our Site that help provide a more personalized and enhanced experience to our users. To achieve this, we may collect and use a limited amount of non-personal information from you. In addition, we may ask you about which books and films in the Ethan Fox Books franchise you have enjoyed. We will never publicly disclose any such information on our Site without obtaining your permission.

7.2 We also collect and share aggregated statistics data about visitors to our Site and traffic patterns with third parties such as our Partners. Just to be clear, this information does not identify users in any personal capacity; it simply gives generalized information about the users of our Site.

8. COOKIES AND LOG FILES

8.1 While on our Site, certain information is automatically logged about how you are using our Site to analyze performance and usage of our Site. This information may include the URL of the website which linked you to our Site, your IP address and the pages you visit while on our Site. The IP address indicates the location of your computer on the internet.

8.2 Like many online services we may use a feature called a cookie. A cookie is a small data file that is sent to your browser from a web server and stored on your computer’s hard drive. It allows us to recognize you as a user when you return to our Site using the same device and web browser. We use the cookies (including some provided to us through online analytics services such as Google Analytics) and other automatically tracked information to:

8.2.1 enable you to move more easily around our Site; and

8.2.2 track visitors to our Site to analyze performance and usage of our Site, in order to develop our Site in accordance with visitors’ requirements.

8.3 You can delete cookies from your hard drive at any time. You can set your internet browser so that it will not allow cookies to be stored on your device. This may reduce functionality of our Site and may mean that certain features or content will not be available to you. Further information on how to prevent cookies from being stored on your device can be found on http://www.allaboutcookies.org under the “manage cookies” section. Alternatively, you can access further information by going to the help menu within your internet browser. To opt out of being tracked by Google Analytics across all websites visit http://tools.google.com/dlpage/gaoptout.

9. LINKS

9.1 Our Site contains links posted by us to third party websites that are not subject to this Privacy Policy. Read the Terms & Conditions for further information on these links. In particular, you will see in our Terms & Conditions that users are not permitted to distribute or post any links including links to websites, files or links that open or run programs. We strongly recommend that you read the privacy policy of any such websites that you visit.

10. HOW DO WE PROTECT PERSONAL INFORMATION?

10.1 As required by law, we follow strict security procedures in the storage and disclosure of information which you have given to us to prevent unauthorized access. In particular, we use Secure Sockets Layer (SSL) to encrypt all your passwords. SSL encrypts the information you provide as it travels through the internet. Encryption creates millions of code combinations to protect each transaction made on the website, so your password or information cannot be viewed by anyone else using the internet. Despite using this technology, we cannot guarantee the security of the information that you disclose to us. You accept the inherent risks of providing information and dealing online and will not hold us responsible for any breach of security unless this is due to our negligence or willful default.

10.2 RPG uses appropriate security measures to protect the information you give us.  While we take stringent measures to protect our websites and all information, you should be aware that no Internet data transmission can be guaranteed to be secure from access by unintended recipients.  It is possible that third parties not under the control of RPG may be able to access or intercept transmissions or private communications without RPG’s permission or knowledge.  While RPG will use all reasonable attempts to keep your information secure, we cannot absolutely guarantee that security.  Thus, any information that you transmit to us is at your own risk.

11. GDPR COMPLIANCE STATEMENT

11.1 GDPR stands for the General Data Protection Regulation and was passed by the European Parliament, the Council of the European Union and the European Commission. The GDPR is a legal framework that sets guidelines for the collection and processing of personal information from individuals who live in the European Union.

11.2 RPG is committed to ensuring the security and protection of the personal information that we process, and to provide a compliant and consistent approach to data protection. We have created this GDPR Compliance Statement to explain our approach to implementing our GDPR compliance program. It describes the implementation of our data protection roles, policies, procedures, controls and measures to ensure ongoing compliance with GDPR.

11.3 As a matter of principles, RPG takes the privacy and security of individuals and their personal information very seriously. Our principles for processing personal information are: (i) we will process all personal information fairly and lawfully; (ii) we will only process personal information for specified and lawful purposes; (iii) where practical, we will keep personal information up to date; and (iv) we will not keep personal information for longer than is necessary.

12. UNSOLICITED MATERIALS

12.1 Through our Site, RPG requests that you provide to us certain types of information so that we may better serve you.  The requested information may include questions and comments about RPG products.  Please do not provide RPG with materials, including but not limited to business, advertising, creative, marketing or any other types of proposals, concepts, know how, ideas and the like (hereinafter, referred to as “Unsolicited Materials”).  All Unsolicited Materials that we receive will not be subject to this Privacy Policy.  By submitting any Unsolicited Materials, you agree that RPG shall have the sole discretion as to how to utilize such Unsolicited Materials and you automatically provide to RPG a perpetual, royalty free license to such end.  If any Unsolicited Materials that you provide to RPG are protected by third party copyright, trademark or other proprietary rights, you agree to indemnify RPG against any claims or actions brought against RPG relating to RPG’s use or possession of the Unsolicited Materials.

13. EDITING YOUR SETTINGS AND UNSUBSCRIBING FROM OUR SITE EMAILS

13.1 We do not send marketing communications to users under 16 years of age.

13.2 If you are a user aged 16 and above and you have previously consented to receiving marketing communications, you can withdraw this consent at any time by changing your Account Settings in your KidsStagramCLUB Account. If you click on the “unsubscribe” link in any marketing communication, it will take you to the Account Settings page.

13.3 You can also edit your settings as described above in 13.2 to update your personal details held by us and to change your:

13.3.1 email address/parent’s or legal guardian’s email address;

13.3.2 country of residence;

13.3.3 language settings, English only; and/or

13.3.4 password.

13.4 Or you may choose to unsubscribe completely by sending an email: unsubscribe@RidgePublishingGroup.com.  Please make sure to include your name, email address and any message.  Please note that any requests may take up to six (6) to eight (8) weeks to become effective.

13.5 RPG may still contact you to send you important information regarding the operation or administration of your KidsStagramCLUB Account.  For additional information regarding RPG’s policies regarding our Site please refer to our Terms & Conditions.

14. ACCESSING AND UPDATING YOUR PERSONAL INFORMATION

14.1 You can access and edit information in your profile in your Account Settings page in your KidsStagramCLUB Account.

Your right to see your personal information.

14.2 Under the Data Protection Act you have the right to see the personal information that we hold about you, whether collected through your use of our Site or through any communications that you have had with us. You will need to provide us with a written request and pay a small fee. If you have any queries about your right or wish to make such a request, please feel free to contact us by emailing us at CustomerService@RidgePublishingGroup.com to find out how you can contact our Data Protection Officer.

15. DELETING YOUR ACCOUNT

15.1 If we suspend or withdraw access to your account for any reason, we will delete your account and any personal information, including any user generated content associated with your account, after six (6) months of withdrawing access unless we reinstate your account or receive a request from you to delete your account sooner (please see paragraph 15.2 for further details). Please see our Terms & Conditions for further details about the suspension of accounts on our Site.

15.2 You can delete your KidsStagramCLUB Account by sending us a request. To find out how to do so, in the first instance, please feel free to contact us by emailing us at CustomerService@RidgePublishingGroup.com. We endeavor to comply with any such requests promptly and in any event within thirty (30) days of receiving your request.

15.3 If, having logged on to your child’s KidsStagramCLUB Account, you inform us that you do not wish your child to use our Site, we will suspend access to your child’s KidsStagramCLUB Account immediately and delete their account (and any personal information collected from them, including any user generated content associated with their account) seven (7) days after receiving your request. Please refer to our Child Safety Policy for further details.

15.4 When we delete your account(s), we will delete all the personal information associated with those accounts including your activity history and user generated content associated with those account(s). You will not be able to participate as a KidsStagramCLUB member unless you create a new account.

15.5 Your personal information and activity history on our Site may persist in our backups after we have deleted your account(s) but will not be available to other users on our Site. We delete our backups every five (5) years and only use them if we need to restore content or functionality on our Site following a systems failure or to assist us with an investigation (please see paragraph 4 above for further information about how else we use your personal information).

16. TRANSFER OF INFORMATION OUTSIDE THE UNITED STATES

16.1 We share your personal information with authorized third-party service providers for the purpose of operating, managing and administering the accounts and services provided to you through our Site.

16.2 Your KidsStagramCLUB Account and all related services are hosted and managed in the United States.

16.3 Your personal information may be transferred to, stored at, or processed at other destinations outside the United States. It may be process by staff operating outside the United States who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the provision of support services.

16.4 By submitting your personal data to our Site, you agree to this transfer, storing or processing. We take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. These steps include our use of model clauses to cover transfer of personal data outside of the United States, or, in the case of the USA, using third parties which have notified the US Department of Commerce that they adhere to the Safe Harbor framework.

16.5 You should be aware that the governments, courts or law enforcement or regulatory authorities of countries outside the United States, in addition to those within the United States, may be able to obtain access to or disclosure of your personal information through the laws of their respective countries.
